ALEC Resolution Text
WHEREAS, the electric grid is a national, network of regional grids engaged in interstate commerce:
WHEREAS, competition and customer choice in the electric industry are enhanced by a seamless, national transmission grid that allows all consumers to choose from either in-state or out-of-state suppliers;
WHEREAS, many states have not finalized plans to implement open-access restructuring of the electric industry after extensive national debate, representing over 75% of national generation and sales:
WHEREAS, the states should retain authority over social and environmental policies as well as the resolution of stranded costs and other transition issues;
WHEREAS, negotiation in each state to finalize open-access restructuring of the electric industry is facilitated by a deadline that directs the parties to find solutions rather than list problems;
WHEREAS, the Federal Government should reform the Public Utility Holding Company Act (PUHCA) and repeal the Public Utility Regulatory Policy Act (PURPA) and reform other federal laws that impede competitive electric markets to complement state plans for the transition to customer choice;
WHEREAS, electricity flows are directed by physical laws and market preferences and not governed by political boundaries; now
THEREFORE BE IT RESOLVED, the {INSERT STATE} endorses date-certain federal legislation of December, 2000 to expedite the transition to competition; and
BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the President of the United States, the Speaker of the House, the President Pro Tempore of the Senate and to every member of this state’s Congressional Delegation.
