Local Cellular Phone Preemption Act Exposed

The Local Cellular Phone Preemption Act was adopted by ALEC's Telecommunications and Information Technology Task Force at the Annual Meeting on August 9, 2002, approved by the the full ALEC Board of Directors in September, 2002. ALEC has attempted to distance itself from this piece of legislation after the launch of ALECexposed.org in 2011, but it has done nothing to get it repealed in the states where it previously pushed for it to be made into law.

Relating to cellular telephones. Be It Enacted by the People of the State of _____:

Section 1.

A city, county or other local government may not enact or enforce any charter provision, ordinance, resolution or other provision regulating the use of cellular telephones in motor vehicles.

Section 2.

Section 1 of this Act applies to all charter provisions, ordinances, resolutions and other provisions regulating the use of cellular telephones in motor vehicles, adopted before, on or after the effective date of this Act.
